Acceptance of This Consent
WHEN YOU CLICK "I AGREE," CHECK AN ACCEPTANCE BOX, OR OTHERWISE AFFIRMATIVELY ACCEPT THIS CONSENT THROUGH THE SERVICE, YOU CONFIRM THAT YOU HAVE READ AND UNDERSTOOD IT AND AGREE TO BE BOUND BY IT. IF YOU DO NOT AGREE, DO NOT CREATE AN ACCOUNT OR USE THE SERVICE. IF SOMEONE ACCEPTS THIS CONSENT ON YOUR BEHALF, YOU AUTHORIZE THAT PERSON TO ACT AS YOUR AGENT FOR THAT PURPOSE.
IN A MEDICAL EMERGENCY, CALL 911. IF YOU ARE HAVING THOUGHTS OF SUICIDE OR SELF-HARM, CALL OR TEXT 988 TO REACH THE 988 SUICIDE & CRISIS LIFELINE.
Purpose and Definitions
This Informed Consent to Telehealth ("Consent") explains how telehealth works and asks for your agreement to receive care through it. Care is delivered by independently licensed physicians, physician assistants, nurse practitioners, and other licensed clinicians ("Providers") through the websites, apps, and platforms operated by Wellmedr LLC and its affiliates ("Wellmedr" and the "Service").
"You" means the person using the Service. Where the Service is used for a minor aged 13 to 17 (or below the age of majority in your state), "you" includes both the parent or legal guardian who consents and the minor receiving care.
What Telehealth Involves
Telehealth is healthcare delivered when you and your Provider are in different places, using electronic communication. Through the Service, it may be used for evaluation, diagnosis, treatment, prescribing, follow-up, and education. It may include:
- Secure messaging, asynchronous questionnaires, and email
- Audio or video visits
- Photos, medical records, and other health information you upload
- Data from medical devices or test results
In-person care is always an alternative, and you may choose it at any time. Talk with your Provider about which option fits your needs.
Possible Benefits
- Faster, more convenient access to care without an office visit
- Care on a schedule that works for you
- Easier follow-up and ongoing communication with your care team
Possible Risks
Telehealth has limits. By using the Service, you understand that:
- A Provider cannot physically examine you, check vital signs, or run in-office tests. This may limit or delay a diagnosis, or mean you need in-person or emergency care instead.
- Your Provider may decide your condition is not appropriate for telehealth, or that a requested treatment is not medically appropriate.
- State laws may restrict what a Provider can prescribe via telehealth.
- Without your full medical history, there is a risk of drug interactions, allergic reactions, or other errors. Complete, honest answers reduce this risk.
- Software, devices, and networks can fail. This may cause delays, lost or corrupted data, or inaccurate records.
- Despite reasonable safeguards, electronic information can be intercepted or accessed without authorization.
- Results are not guaranteed. Your condition may not improve and may get worse.
Emergencies and Follow-Up Care
The Service is not for emergencies. If you have an emergency, call 911 or go to the nearest emergency room. Providers may not respond to messages right away. For non-urgent questions, use secure messaging in the Service. If a technical problem prevents you from reaching your care team, contact Wellmedr support at 1-888-397-6905 (8 AM to 8 PM ET) or support@wellmedr.com.
You are responsible for keeping your primary care provider informed and for arranging any in-person follow-up your Provider recommends.
Privacy and Security
Wellmedr uses administrative, technical, and physical safeguards designed to protect your information. Your protected health information is used and disclosed only with your authorization or as permitted or required by law, including for treatment, payment, and healthcare operations, and for mandatory reporting (for example, risk of serious harm, or suspected abuse of a child, elder, or vulnerable adult). Details are in our Privacy Policy.
The Service may send you emails or text messages that contain health information. Wellmedr cannot control the security of your email provider, phone carrier, or personal devices.
Open Payments Notice
The federal Physician Payments Sunshine Act requires drug, device, and biologic manufacturers to report payments and transfers of value to physicians and teaching hospitals. The Centers for Medicare & Medicaid Services publishes this data in its searchable Open Payments database at openpaymentsdata.cms.gov. This notice is for your information only.
Your Acknowledgments
By accepting this Consent, you acknowledge and agree that:
- Your care through the Service will be delivered by telehealth, and your Provider may be a nurse practitioner or physician assistant rather than a physician.
- Your Provider decides, in their independent clinical judgment, whether telehealth is appropriate for you and whether any treatment or prescription is medically appropriate. By continuing, you agree to be evaluated and treated this way.
- Your Provider may refer you to a specialist or to in-person care if telehealth is not suitable.
- Telehealth and the technology behind it are evolving and may include tools not described here, some of which may be in development. No particular outcome is guaranteed.
- Visits will not be recorded by you or your Provider.
- You will give complete, accurate, and truthful information, including your medical history, current medications, allergies, and care from other providers.
- You may withdraw this Consent at any time by written notice to your Provider, without affecting your right to future care elsewhere. Withdrawal takes effect when received and does not affect actions already taken in reliance on it. Providers on the Service do not offer in-person care.
- You are responsible for all costs of the Service, including medications, and you will not submit claims for them to Medicare, Medicaid, any other federal or state program, or any private insurer.
